Release of Liability for Drivers




To seasoned Administrators:

Remember the good old days when residents wanting to drive while residing in the facility was simply not a factor? Well, recently our facility admitted a resident who insisted on being able to drive while being cared for. I believe this trend will continue so I put together this disclosure statement with the help of my brother the lawyer that hopefully covers all the liability issues of such a scenario. Feel free to use it...could come in handy!


Driving is considered a privilege. (name of facility) does not encourage or prohibit residents from driving their own private vehicles. The facility requires compliance with all state laws and regulations pertaining to the rules of driving.



In an effort to extend the privilege of driving to all residents the following conditions apply:



  1. The facility shall be held harmless in the event of accidents, injury or damage caused by the resident due to any and all acts resulting from use
    of the vehicle.
  2. The resident must maintain liability coverage at all times.
  3. The determination for driving privileges to cease may be made by an agreement by the facility staff, the resident’s physician, and the resident (or
    responsible party).
  4. The resident is responsible for losses to the vehicle including theft of the vehicle or its contents.
  5. Passengers in the resident’s vehicle shall hold the facility harmless for any injuries resulting from the actions of the resident while in the
    resident’s vehicle.
  6. Proof of insurance must be available upon request.
  7. All costs of maintaining the vehicle are the sole responsibility of the resident.
  8. If the facility deems the vehicle does not meet minimal safety standards established by the State, the vehicle may not be operated until such
    repairs have been made and meet the standards established by the State.
  9. All licensure, taxes and state required operation standards are the responsibility of the resident.
  10. The resident agrees to adhere to all driving regulations established by the State.
  11. The resident will record, with the state department, the current address of the facility on the current driver’s license and registration.










By signing below, resident and or responsible family members acknowledge and agree to the guidelines established by the facility for driving privileges set forth by the facility.
